对建设工程委托监理费用支付模式的探讨

摘　　要：自建设工程监理制度在我国实施以来,在提高建设工程质量方面成效颇为显著。但是,越来越多的不足之处,如建设工程监理职权不独立等问题逐渐暴露出来。通过探析我国建设工程监理事业的发展历程,在详细分析现行建设工程委托监理费用支付模式缺陷的基础上,提出了第三方支付建设工程委托监理费用的观点。即由第三方依据有关建设质量管理职能部门的阶段性质量验收资料和《建设工程委托监理合同》中约定的相关条款支付建设工程委托监理费用。这种新的支付模式将在解决现存诸多问题的基础上,有力地推动我国建设工程监理事业的发展。Since the construction project supervision system has been implemented in our country,its effect is quite remarkable in improving the quality of construction projects. However,more and more deficiencies gradually exposed in the implementation process of the construction project supervision system,for example,the non-independence of the supervisory authority of the construction project has not been effectively resolved. This paper puts forward the viewpoint of the third party to pay the cost of construction project supervision through the analysis of the development process of China＇s construction engineering supervision and on the basis of a detailed analysis of the current construction engineering supervision cost of construction project mode＇s defects. Namely,the third party pays the cost of construction project supervision in accordance with the stage quality acceptance data of relevant construction quality management function and several terms concerned appointed by the ＂construction project supervision contract＂,in which the third party refers to the enterprises or social organizations owned high degree credit. This new mode of payment will effectively promote the development of the construction industry based on solving the several existing problems in China.
