历史发展视野下法律制度民族局限性论析

摘　　要：基于马克思主义历史发展观,本文紧扣博登海默评价历史法学派的著名论断,主要从法律制度进化论的视角,论述了德国历史法学派关于法律制度具有民族局限性的观点,证实了博登海默在评价历史法学派时所提出的普适性法律制度建构的标准,逐步厘清了法哲学上真正困扰人们的难题,客观地评价了历史法学派,这有助于法学科学地位的确立和巩固,并对于我国民事立法中继承其他国家优秀法律制度遗产具有重大理论意义。Based on Marx＇s view of historical development, paper buckled the famous assertion about Bodenheimer＇s evaluation on history law School tightly, from legal system evolution of perspective mainly, and discussed the views that legal system has national limitations for the Germany history law school, and confirmed the legal system construction standard put up by Bodenheimer when he had evaluated on history law School, and gradually made it clear that has troubled people from the legal philosophy, objectively evaluated the history law school, which helped to establish and consolidate the law science status. And it is of great theoretical significance to inherit excellent heritage of legal system of other countries for our civil legislation in the future.
