新型城镇化下农村土地法律制度适应性变革——以“三权分置”为视角

摘　　要：城镇化率的快速提高,一方面有利于国家产业结构的优化,成为解决"三农"问题和协调区域发展的重要途径,另一方面也可能造成农村土地资源有效配置不足的问题,如土地经营权的性质有待明确、农村土地流转有待"去行政化"、农村土地流转操作细则有待完善等。这些问题的解决,是我国实现现代化和建设社会主义新农村的必然选择。在"三权分置"的背景下,农村土地流转法律制度却面临的现实困境,成为发展现代化农业和新型城镇化建设道路上的障碍,而再次释放土地改革所带来的经济"红利",须在协调市场化与行政化的关系中有序推动新型城镇化建设。The rapid improvement of the urbanization rate, on the one hand is advantageous to the country industrial structure optimization, becomes the solution of ＂three agriculture＂ question and the important way of coordinating the region development; on the other hand, it also possibly creates the problem which the countryside land resource effective disposition is insufficient, such as the nature of land management fights to be clear, the circulation of rural land needs to be de-administration, the operation regulation of countryside land transfer needs to be improved and so on. The solution to this problem is an inevitable choice for our country to realize modernization and build a new socialist countryside. Under the background of the three-fight separation, rural land transfer legal system is facing the reality of the plight of the development of modern agriculture and the construction of new urbanization obstacles. And once again release the land reform brought about by the economic dividend have to coordinate the relationship between tile market and the executive order to promote the construction of new urbanization.
