西部地区社会稳定的法治路径与对策研究——以云南楚雄“大调解”机制为例

摘　　要：伴随着经济社会的转型,我国社会矛盾纠纷不断加剧、日趋复杂,采用何种路径与对策化解社会矛盾纠纷已成为包括西部地区在内的全国性课题。作为西部地区之一的云南省楚雄市结合当地实际,通过整合人民调解、行政调解、司法调解、行业协会调解、仲裁调解等资源,构建"五调联动"、覆盖城乡、低成本的"大调解"机制,成为西部地区社会稳定的一种有价值的法治路径。同时必须基于该机制运行中存在的不足,不断对其加以完善。China is in some increasingly complex social contradictions with the period of social economic transition. It is a nationally representative subject in what ways and countermeasures be taken to resolve social distributes and conflicts. Yunnan is a province of west China. Chuxiong, a city of Yunnan, has started combing the local actual situation and covering urban-rural areas to construct a low-cost ＂muhipartite mediation＂ mechanism of five-interaction-mediations which are people mediation, administrative mediation, judicial mediation, association mediation and arbitration mediation. This mechanism has been a valuable way of rule by law acting on social stability in west China. Meanwhile, it is also necessary to continuous improve this mechanism basing on its shortage.
