摘　　要：完善全国人大及其常委会宪法监督制度,依法撤销和纠正违宪违法的规范性文件,是十八届四中全会提出的重要任务。就现有的宪法监督制度设置及其实施而言,全国人大的违宪审查在监督能力、监督地位与监督程序等方面存在较大的局限性。违宪审查的模式选择应当考量宪法体制、政治条件与司法条件三个方面的现实因素。为保障违宪审查模式的实效性,应在全国人大设置独立的"宪法委员会",确立法院针对违宪审查的移送机制,在违宪审查决定上采用温和的建议或宣告方式。According to the fourth plenary session of the 18th Communist Party of China Central Committee, the National People＇s Congress and its Standing Committee should play a better role in supervising the Constitution＇s implementation.
