中国离婚制度的探析

摘　　要：家庭是社会的因子,婚姻是社会的缩影。婚姻家庭制度的演变,折射出社会思想理念的变迁,反映出一个时代的鲜明特征,而离婚问题是婚姻法律关系中不可忽略的一部分。离婚自由及其限制是离婚制度的基础理论问题。本文以自由、尊重的价值取向为出发点,纵观中国离婚制度的发展进程,通过文献研究、社会实证分析等研究方法,结合目前当代我国的婚姻社会现状,系统分析了离婚自由与限制在当前面临的问题与挑战,结合我国现行婚姻法制度对我国离婚制度目前存在的一些问题提出了意见与建议,以期为完善我国的离婚制度提供些许帮助。Family is the factor of society, while marriage is a epitome of the era. Actually, the history of marriage and family is an epitome of the society or the era. Divorce is an unforgettable part in the legal relationship of marriage. In order to study the problem of marriage, divorce freedom and restriction is a basic question. This paper focuses on balancing the freedom and justice, through the consult massive literature material, and adopts the ways and means of history analyzing and social analytic demonstration to purse the development of divorce freedom and analyses the challenges and problems facing by the freedom of divorce in modern society. This paper has a rational and systematic thought about the relevant system in China and puts forward some problems existing in Chinese divorce system and views about the system. In order to improve the Chinese divorce system, l design the specific path and system architecture.
