摘 要:价格行政执法承担着部分商品与服务定价、行政事业性收费监管、通过反价格垄断执法实现市场公平竞争等任务,对社会主义市场经济健康发展及社会秩序稳定起着极为重要的作用。受传统压制型行政模式合法性异化的影响,价格行政执法面临着内外双重执法困境,在多元异质的社会需求面前产生了诸多风险,影响了行政执法目的和公共利益的实现。为了有效实现价格执法风险的法律规制,以回应型行政执法模式为理论基础,构建了包括风险评估、改进现有制度、公众参与及购买公共服务为核心的制度体系,进而真正实现法治政府与治理现代化的双重目标。Administrative law enforcement of price takes the mission of part pricing for commodity and service, supervision of administrative charges of non-profit-making service and implementation of fair market competition by law enforcement of anti-price monopoly, which plays an important role in healthy development of socialist market economy and stable social order. Impacted by dissimilation of traditional suppressing type administrative mode validity, the administrative law enforcement of price faces dual internal-external enforcement dilemma, and it has produces a lot of risks under the social demand of multiple heterogeneity, which hampered the implementation of purpose of administrative law enforcement and public profit. In order to effectively realize the legal regulation of administrative law enforcement risk of price, this paper takes respondent administrative law enforcement mode as theoretical foundation, establishes system including risk assessment, improvement in current system, public participation and purchasing public service as core, and then truly realize the dual targets of legal government and governing modernization.
