摘 要:食品安全风险警示行为的不当使用会给相对人的利益带来不可挽回的损失,因而警示行为应当受控。基于外部控制效果的有限性和内部规制的必要性原则,必须加强对食品安全风险警示行为的行政自制。行政组织以及人员结构的重构,内部行政规则的制定,内部行政监督以及责任设置的细致化、合理化是构建警示行为行政自制模式的基本路径。Warning behavior of food safety risk will bring the irreparable loss to the other party, thus warning behavior should be controlled. Based on the limited effects of external control and the theory of the administrative self-restraint principle, it should strengthen the administration self-restraint to warning behavior of food safety risk. Reconstruction of administrative organization and personnel structure, internal administrative rules, internal administrative supervision and refining, rationalizing administrative responsibility are the fundamental paths which establish the mode of administrative self- restraint to warning behavior.
