法学视阈下安徽省实施排污权交易的研究

摘　　要：2017年底全国范围将推动实施排污权交易,安徽省实施排污权交易既面临挑战又具有机遇。安徽省排污权交易起步较晚,在全国属于滞后省份;在相关法规政策制定方面较为落后,应迎头赶上其他地区。法学视阈下研究安徽省排污权交易为其探索出一条创新、高效的路径:首先尽快制定与实施符合本省特点的排污权交易实施细则与办法,构建实施排污权交易的法规政策体系;其次通过法律实施,完善和规范排污权交易监督和约束机制。建议通过规范交易主体权责、搭建区域性交易平台构建安徽省排污权交易市场。In the end of 2017, China will impiement emissions trading all over the country, and Anhui Province is faced with both challenges and opportunities. Emissions trading in Anhui started much later than that in many other provinces, and formulation of relevant laws and policies also falls behind, which should be accelerated to catch up with other provinces. In order to find an innovative and effective route from legal perspective for emissions trading in the province, firstly it is necessary to formulate and implement as soon as possible detailed rules and measures in line with current situation of the province and establish law and policy system to implement the trading; secondly, it is also necessary to perfect and regulate supervision mechanism and restriction mechanism for the trading through law enforcement. We suggest to building emissions market by making clear the rights and liabilities of trading subject, and setting up regional trading platforms.
