摘  要:法治思维是一种新的法治理念,对于中国改革路径选择具有深远影响。本研究通过分析当前法治建设的状况,深入阐释法治思维、党员干部法治思维及与依法办事之间的关系,指出法治思维是与人治思维、特权方式相对立的观念行为,其核心要义是用法律限制权力的恣意行使。然而受传统人治、权力本位和重实体轻程序等历史因素影响,我国法治思维从一个行动指南到实践规则还需要长期的努力和坚持。因此,探析在法治理念教育、完善监督制约机制和落实法治考核实绩等方面构建提高党员干部法治思维的制度机制和模式体系,形成从思想到行为、从权力到责任、从制度到能力的可行路径,为凝聚改革共识、培育法治精神、带动全社会形成良好法治环境以及积极稳妥地全面推进依法治国奠定牢固基础。The rule-of-law thinking is a new concept of rule of law, which has a profound influence on China's reform. By analyzing the current situation of the construction of rule of law, making in-depth interpretation of the relationships among rule-of-law thinking, Party leaders' rule-of-law thinking and acting in accordance with the law, this paper pointed out that rule of law is opposite to rule of man and privileged mode, its core essence is to restrict power abuse by law. However, influenced by historical factors like the traditional rule of man, power-oriented thinking and preferring substantial law to procedural law, China's legal thinking from a guide to practice rules still need long-term efforts and persistence. Therefore, it's necessary to construct the system of rule-of-law thinking for Party members and leaders from perspectives of education on the concept of the rule of law, improving the supervision mechanism and implementing performance appraisal. Thus forming a feasible path from thought to behavior, from power to responsibility, and from the system to the ability, laying a solid foundation for building consensus on reform, cultivating the spirit of the rule of law, promoting the whole society to form a good legal environment, and actively and steadily improving the rule of law in China.
