“释宪台独”的政治意涵、表现形式与应对策略

摘　　要："释宪台独"是指台湾地区具有"释宪权"的司法机关通过极其隐晦的方式,借助司法个案对现行"宪法"进行违背"两岸同属一个中国"事实的解释,通过大量法律辞藻的包装推动"台独"的活动。基于台湾地区"释宪"机制和对岛内政治格局的综合分析,本文研判未来民进党当局通过个案解释的方法推动"释宪台独"的可能性较大,可能在2019年"司法院"第二轮人事变动后开始推动"释宪台独"活动。大陆方面应充分重视"释宪台独"对两岸关系发展的危害性,借助释宪、释法和司法审判活动等法治方式,形成应对"释宪台独"的法治策略体系。＂Taiwan Independence by Constitutional Interpretations＂ refers to the intent and moves of the judicial authorities in Taiwan to promote ＂Taiwan Independence＂ by the implicit approach of exploiting individual cases to interpret the prevailing ＂constitution＂ in Taiwan in ways that are counter to the fact that both sides across the Taiwan Strait belong to one China. Through a comprehensive a nalysis o political f the mechanisms for ＂constitutional interpretations＂ of the judicial authorities as well as the spectrum in Taiwan, this article concludes that the Democratic Progressive Party （DPP） authorities are very likely to adopt such an approach to promote ＂Taiwan Independence＂ after the second round of personnel shifts of the ＂Judicial Yuan＂ in 2019. In this regard, the Chinese main land must keep alert to the hazards of the DPP moves and construct an effective legalgang strategic framework to tackle them by such legal approaches as interpreting the Constitution and related laws as well as taking other judicial actions.
