传销治理的公法规制思考

摘　　要："互联网+"时代里经济飞速发展,传销这一空手套白狼的"盈利"方式备受投机者青睐。此种"经济发展方式"已然成为阻碍我国经济发展的毒瘤亟需以法律手段予以根治。公法规制方式无疑是最受青睐的传销行为治理手段。但我国目前对传销行为的公法规制方式存在着犯罪主体不明确、刑罚类型运用不充分、组织、领导传销活动罪中"情节严重"缺乏具体标准、行政执法部门分工不明确等诸多问题,通过纳入明确犯罪主体、增设没收财产刑、增加自由刑的档次和幅度、明确行政执法部门分工以及整合行政执法资源无疑将有利于传销治理的效果。＂Internet plus＂era of rapid economic development,marketing this sleight of hand ＂profit＂ means highly favored speculators. The ＂economic development＂ has become an obstacle to our economic development we need to take legal means to cure cancer. Public law regulation mode is undoubtedly the most popular means of marketing behavior management. But at present our country of the pyramid schemes of the public law regulation has the subject of crime is not clear,the type of use is not sufficient,the crime of organizing and leading MLM in ＂serious＂ lack of specific standards,administrative law enforcement departments in the division of labor is not clear and many other issues,through the inclusion of explicit subject of crime,the penalty of confiscation of property,increase additional grades and departments the amplitude,free sentence is clear about the administrative law enforcement division and the integration of administrative law enforcement resources will undoubtedly help the MLM governance effect.
