未成年人刑事司法转处的国际准则与本土化思考

摘　　要：未成年人刑事司法转处是未成年人刑事司法的核心。未成年人刑事司法国际准则集各国司法实践之经验为司法转处提供了基本指导和标准:转处依据的多样性且强调未成年人的福祉,转处阶段的全程性且尽早进行转处,决定主体的专业化与多元化且自由裁量权较大,转处方案的多样性且适当进行干预。结合我国未成年人司法转处的现状,剖析未成年人刑事司法转处在我国继续推进的可能性,发现未成年人刑事司法转处在我国本土化难以避免成年人刑事司法模式的控制和影响,公安机关无须过于积极地参与对涉罪未成年人的司法转处,社区功能的发挥非常有限,应当尽量避免不合理的区别对待。Juvenile criminal justice diversion is the core of juvenile criminal justice. The international standard of juvenile criminal justice integrates experience of judicial practice in various countries to provide basic guidance and standard for judicial diversion. The diversion foundation is multifarious and emphasizes the welfare of juveniles. The diversion stage be full of process and shall be taken as soon as possible. The subject is professional, diversified and has greater freedom of judicial discretion. The diversion scheme is diversified and shall be properly intervened. According to the current condition of juvenile justice diversion in China, we study the practice present situation of juvenile criminal justice in China and the possibility to continue. Find that its localization in China is difficult to avoid the control and influence of adult criminal justice mode. Public security organization need not be actively involved in the juvenile criminal justice diversion in crimes. As community function is very limited, unreasonable treatment should be avoided as far as possible.
