摘 要:公众参与在新《环境保护法》中被作为一项环保领域的基本原则加以确定,明确了公民、法人和其他组织有获取环境信息、参与和监督环境保护的权利,公众在自身环境利益的驱使下有参与环境公共决策甚或提起环境公益诉讼的诉求。环境保护公众参与的核心价值在于建立一种能够使社会公众与政府或其他公共机构双向沟通的机制,使公众能够参与到环境事务的决策中来。然而,在转型期的中国,在大数据环境下,公众参与在实践中尚存在诸多制约因素,严重影响了公众参与的深度与广度。我国应运用现代信息技术合理搭建公众参与平台,构建"互联网+"绿色生态,实现生态环境数据互联互通和开放共享。Public participation in the new environment protection law, as the basic principles of a field of environmental protection to be determined clearly, the citizens, legal persons and other organizations to obtain environmental information, participation and supervision of environ- mental protection of the rights of public driven by the interests of their own environment, partici-pation in environmental public decision - making or even mention the demands of the environ- mental public interest litigation. The core value of public participation in environmental protec- tion is to establish a mechanism which enables the public to communicate with the government or other public institutions, so that the public can participate in the decision - making of environ- mental affairs. However, in the transition period of China, in the big data environment, the pub- lic participation in practice there are still many constraints, a serious impact on the depth and breadth of public participation. Therefore, China should use modern information technology to build reasonable public participation platform, construction of "green ecological Internet plus", realize the ecological environment data interoperability and open sharing.
