疑难案件裁判的反思及其方法论构建

摘　　要：一般而言,裁判的方法是逻辑三段论法在司法领域的运用。然而,由于制定法体系的封闭性,从一般到个别的演绎推理方法显然无法涵盖社会生活事实之全部。因此,在运用逻辑三段论法进行案件的裁判时,又发展出了各种法律解释方法。三段论法对于众多较为典型和常见的简易案件而言是足够的。但是面对复杂疑难案件,则显得苍白无力。实践中,疑难案件由于其本身所涵盖的事实类型与简易案件并不一致,因此,需要综合运用法律解释与法律论证的各种方法为疑难案件的裁判提供方法论的支持,并从法律论证的角度构建疑难案件的裁判方法。In general,judging method is the application of logic syllogism in the field of justice.However,due to the closure of the law system,the deductive reasoning methods from the general to the individual clearly can not cover all the facts of the social life.Therefore,based onthe logical syllogism case judgment,various methods of legal interpretation have been developed.The logic syllogism is enough for many typical and common cases.But in the face of complex and difficult cases,it is apparently weak.In practice,due to the difference between the types of facts the difficult complex cases covered and that of the simple cases,therefore,it is very necessary to use various methods of legal interpretation and legal argumentation to provide methodological support to the difficult and complex casesand construct the judgment method from the angle the legal argumentation.
