改革和完善我国海事审判制度的几点建议

摘　　要：海洋强国、"一带一路"、国际航运中心建设等国家战略的推进给我国海事司法提供了历史性机遇,并提出了为国家海洋权益提供司法保障、建设国际海事司法中心等新的要求。我国海事司法有着得天独厚的一些优势,但是也存在法律地位不明确、管理体制不顺、诉讼管辖不完善等问题。今后应当明确海事法院的法律地位,统一和理顺海事法院管理体制;设立海事高级法院和最高人民法院海事审判庭,构建海事专门法院体系;完善海事案件专门管辖制度,试点涉海案件的"三审合一"。The national strategy for maritime power, the Belt and Road strategy, the construction of international shipping center and other national strategies have provided a historic opportunity for promo-ting the development of Chinas maritime justice, which requires the judicial protection of the national mar-itime rights and interests, and the construction of the International Maritime Judicial Center. China＇s mari- time justice has unique advantages, but there are also problems such as unclear legal status, hindered man-agement system, imperfect litigation jurisdiction and so on. Thus, the suggestions are that in the future, the legal status of the maritime court should be clarified？ and the maritime court management system should be unified and rationalized; moreover, maritime high court and maritime trial court under the Su-preme Peoples Court should be established？ and the maritime special court system should be constructed; the jurisdiction system for special maritime cases should be improved, and a pilot project on maritime cases applying the mode ＂three trials in one＂ should be launched.
