医疗损害案件中精神损害赔偿相关问题探讨

摘　　要：《中华人民共和国侵权责任法》对精神损害赔偿的规定扩大了医疗损害赔偿的范围。本文根据《侵权责任法》医疗损害构成要件和认定程序,认为精神损害赔偿是医疗损害赔偿中的重要组成部分,同时对精神损害赔偿的范围进行了一些思考。为了更好地平衡医患利益,笔者建议应该在医疗损害赔偿中进一步规范精神损害的赔偿范围和数额。Mental damage compensation regulation in Tort Law of the People＇s Republic of China has enlarged the range of medical damage compensation. According to the component and identification procedure for medical damages in Tort Law, this paper believed that mental damage compensation was an important component for medical damage compensation, and gave some consideration on the range of mental damage compensation. In order to better balance the profit between hospital and patient, the author thought it was necessary to further define the compensation range and amount of mental damage in medical damage compensation.
