摘 要:根据我国《环境影响评价法》等相关法律规定,应当编制环境影响报告书的项目必须适用公众参与程序,而对于应当编制环境影响报告表的建设项目是否适用公众参与程序则没有明确规定。通过对法规的梳理和对现行环评公众参与制度的检讨,我们发现,应当编制环境影响报告表的建设项目的公众参与存在专门性规范缺失、听证会模式发挥空间有限以及编制过程缺乏公众参与等问题,而这些问题存在的原因在于对受影响公众私益的忽视。鉴于现有的法律规范对应当编制环境影响报告表的建设项目的公众参与基本无保障作用,应拓宽环评公众参与的适用范围,将部分应当编制环境影响报告表的建设项目纳入其中。Under current law,only the projects necessary to work out an environmental impact list are included in the range of application of public participation in EIA.And yet,there is no clear regulation on the public participation in EIA for the construction projects,which are required to work out an environmental impact list.Through an examination of the current law and public participation,the following problems are found:First,there are no special rules on the public participation in EIA for construction projects,necessary to work out an environmental impact list.Second,public hearing is restricted by its mode,only to find its role not fully played.And there is no public participation in the making of EIA.The main reason for these problems is the negligence of the private interests violated.Given that the public participation in EIA for the constructions projects,necessary to work out an environmental impact list almost gets no support from current law,the range of application of public participation in EIA should be enlarged and part of construction projects,necessary to work out an environmental impact list,should be involved.
