行政执法中的非强制行为分析

摘　　要：传统的行政执法强调管理与被管理、命令与服从,对于行政相对人的感受和诉求多有忽略。随着社会治理观念的变革,行政执法越来越重视非强制行为的运用,行政执法中的非强制行为力图通过与行政相对人的沟通、引导、利益激励等来获得其自觉自为的回应和配合,实现行政管理的目标。行政执法的非强制性行为是现代公共行政管理改革的方向和行政法治化的路径之一。但实践中出现的某些示弱式执法却表现了执法者庸政、懒政及对公共利益和秩序的背离。提倡行政执法的非强制行为并不是要行政主体对违法行为一味地容忍,而是更需要法律化、制度化的柔性行政措施,并辅之以刚性的行政手段为后盾,实现社会公共利益的最大化。The compulsory administrative law enforcement simply focus on management and managed, command and obedience, and the administrative counterpart＇s feelings and pleadings have been ignored; but the non-compulsory law-enforcement action is trying to achieve the expected goals of administrative management through the self-conscious and voluntary responses and cooperation of the administrative counterpart. The non-compulsory law-enforcement action is one of the path to the direction of the management mechanism reform of modern public administration and administrative legalization. But some weakness law-enforcement practices reflect law enforcers＇ vulgar and lazy administration as well as the deviation from the public interest and order, contrary to the self-consciousness and voluntary advocated by the non-compulsory action. Advocating non-compulsory of administrative law enforcement does not mean the blind tolerance of administrative body to the unlawful acts on the surface, it needs more legal and institutionalized flexible administrative measures which should be supported by rigid administrative means, and maximize the public interest through tensed and relaxed measures.
