论未成年人国家监护的立法构建——兼论民法典婚姻家庭编监护部分的制度设计

摘　　要：西方国家的未成年人国家监护主要体现为国家司法权和行政权对监护各个环节的介入和监督,同时也体现为国家对未成年人监护的审慎态度,即通过严谨细致的条文设计最大限度地保护未成年人的人身权利和财产权利。我国正处于民法典编纂过程中,民法总则包含了监护制度的原则性规定,由此决定了监护制度分属总则和婚姻家庭编的立法格局。目前总则已通过立法审议,婚姻家庭编的修订工作正在进行。婚姻家庭编在设计未成年人监护制度时,应在总则原则性规定之下细化监护的各项内容,体现和强化国家监护的性质和表现形式,以实现国家对未成年人的立法保护。In the western countries,the state custody of minors is mainly embodied in the intervention and supervision of the national judicial power and executive power in each link of custody process. It is also embodied in the prudent attitude of the state to the minor custody. It means that state protects minor ＇ s personal rights and property rights maximum through compact clauses designing. Right now our country is just in the proceeding of compilation of civil law. The principle provision of custody system is involved in the general principles of civil law. This determines the pattern of guardianship legislation belongs to general and marriage and family part respectively. Recently the general principles had just passed legislative deliberation.Marriage and Family Law is in the proceeding of revision. During this proceeding the Marriage and Family Law should detail the contents of custody under the general principles,reflecting and strengthening the nature and forms of state custody so that it can get the targets of protecting minors by legislation.
