摘　　要：虽然国际社会越发重视国有企业规则的构建,高水平的国有企业规则已经成为国际贸易规则的发展趋势,国有企业补贴仍是各国不敢轻易触及的"敏感领域"。非商业支持规则填补了这一空白,为国有企业国际补贴规则树立了新的范式。非商业支持规则诸多规定与SCM协定重合,同时简化了认定补贴构成的步骤,放宽了不利影响及损害的相关规定,事实上扩大了《补贴与反补贴协定》的适用范围。一旦非商业支持规则成为国有企业补贴规则的模板,将十分不利于我国国有企业开展对外贸易。我国应当提前做好准备,迎接当前国际贸易大环境下的机遇和挑战。Even though international society has paid much more attention on the importance of the state-owned enterprises rules construction and the high level state-owned enterprises rules have been the development tendency of international trade rules,the subsidies of state-owned enterprises is still the sensitive area which countries can ＇ t deal with easily. Non-commercial assistance has filled this gap and established the new paradigm for the rules of state-owned enterprises subsidy. The main provisions of non-commercial assistance are overlapped with the SCM agreement. At the same time the rules simple the procedures of the non-commercial assistance constitution and loosen the relevant rules of the adverse impact and injury,which expanding the application scope of the SCM agreement actually. If non-commercial assistance becoming the templet of the state-owned enterprise subsidy rules, the business activities of state-owned enterprises in our country will be at the disadvantage. So China should be prepared in advance to meet the chances and challenges under the international trade.
