安全监管信息公开问题的法理考察——以危险化学品重大危险源信息公开为例

摘　　要：安全生产监管信息公开是对公共信息资源配置的一种行政行为。政府信息公开是民主政治进步的表现。世界各国的普遍做法是公开为原则,不公开为例外。在我国受传统行政方式及思想的影响,个别行政主体在信息公开过程中往往存在着以不公开为原则、以公开为例外的现象;在公开还是不公开信息的利益博弈中,公共利益成为关键的平衡器。从安全监管信息公开的法律位阶、与公民知情权的关系以及自由裁量权的角度分析,那些公开的信息,其背后的公共利益往往与知情权、民主政治、公众参与等价值相关;而不公开的信息,其背后的公共利益则更多考虑公共安全与社会利益。利益主体的多元性和公共利益的两面性的存在,加大了安监部门政府信息公开中利益衡量的复杂程度。安监部门决定某一信息是否公开,不仅需要合理使用自由裁量权,还需要在合法与合理中体现出政府部门执政为民的理念,以及执法的智慧与自信。The information disclosure of the production safety supervision is a kind of administrative behavior of public information resource configuration. Government information disclosure is a form of democratic politi- cal progress. It is a common practice for countries all over the world to open as a principle and close as an ex- ception. In our country, Under the influence of traditional administrative methods and ideas, the individual administrative subject are often closed as a principle and open as an exception in the process of information disclosure. In the interests of the public or non - public information game, the public interest has become a key balancer. From the safety supervision information disclosure legal status, the relation of the citizens＇right to know and discretion of perspective, the public interests behind of the public information, are often associat- ed with the fight to know, democracy, public participation and other related values; while the opposite pays more attention to public safety and social interests. The diversity of stakeholders and dual characters of public interests, increase the complexity for the safety departments when they weight the advantages and disadvanta-ges of disclosing the government information. To determine whether a particular information is in public, safety department not only need to reasonable use discretion, but also need to be in the legal and reasonable mani- fests the government departments to the idea of governing for the people, and the wisdom and confidence of law enforcement.
