民间文学艺术表达保护模式选择:误区、澄清与展望

摘　　要：我国学术界与实务界对于民间文学艺术表达保护模式的选择存在认识误区。结合域外相关制度的发展沿革与我国立法实践,可知民间文学艺术表达"版权法私法保护模式不能成为最先考虑途径"、"《非物质文化遗产法》公法保护模式并非最优路径选择"、"特别权利保护模式构建时机尚未成熟"的结论。固然,理论迷雾不能阻却前行的步伐,因此我们在检视现有理论缺陷的同时,应当探寻民间文学艺术表达保护模式的最佳路径选择,即构建公、私法二元保护模式;在此基础上,应当树立民间文学艺术表达保护创新观,借鉴物权及其衍生理论"二元知识产权体系"构建民间文学艺术表达权,从而充分释放其内在价值。There exists some misunderstanding regarding the choice of the protection mode of folklore expression in China＇ saeademic and practical circles. Combined with the practice of development of foreign relevant system and the legislation ofChina, it is found that about the folklore expression, ＂the copyright law protection mode cannot be the first way to be con-sidered＂, ＂the public law protection mode of ＇The Intangible Cultural Heritage Law＇ is not the optimal path to be select-ed＂, and ＂the special right protection mode is not mature＂. Of course, the theory of fog cannot obstruct pace, so we exam-ine the defects of the existing theory at the same time, and we should choose the best path to explore the expression of folk-lore protection mode, namely, the construction of dual modes for the public law and the private law protection; Based onthis, we should establish the concept of folklore expression protection innovation, reference construction property right, andits derivative the theory of ＂dual intellectual property system of folklore expression＂, so as to fully release their intrinsicvalue.
