农村集体建设用地流转的地方法治探索与制度前景

摘　　要：随着新型城镇化推进使得农村集体建设用地流转成为焦点。但是目前农村集体建设用地流转的制度障碍主要体现在现行《宪法》第10条、《土地管理法》第43条、第63条以及《物权法》《担保法》的限制性规定。土地流转的地方法治实践已经突破了国家现行法律的限制,主要体现在,农村集体建设用地使用权流转用途非农化、流转方式多样化以及宅基地流转方面。地方政府积极推动农村集体建设用地使用权流转和地方政府对土地财政的依赖有直接的关系,地方法治探索有利于推动国家法治的发展完善,但是这种探索需要在法治框架下进行,使得农民个体的权益能够得到最终维护和保障。With the development of new urbanization, rural collective construction land transfer has become inevitable. But the current system of rural collective construction land transfer is mainly reflected in the current ＂constitution＂ tenth, ＂land management law＂ forty - third, 63, and the ＂property law＂, ＂security law＂ of the restrictive provisions. Land circulation of the local legal practice has exceeded the limita- tion of current national law, mainly reflected in, rural collective construction land use circulation of the right to use non agricuhuralization and circulation way diversification and the homestead circulation. Local governments actively promote the rural collective construction land use rights transfer and local government dependent on the land finance is directly related to, the local law exploration is conducive to promote the development of the country under the rule of law perfect, but the exploration needs to be carried out in the framework of the rule of law, making the rights and interests of individual farmers to get the final safeguard and protect.
