摘　　要：中国新疆作为"一带一路"战略的核心区,我国的自然资源、边贸大省,在"十三五"时期若要取得资源开发与环境保护关系平衡的突破,克服经济发展中能源不足的"瓶颈"问题,就必须放眼周边国家积极寻求清洁能源的跨境引入。中国新疆所毗邻的吉尔吉斯斯坦具有水力资源大国、"一带一路"参与国、上合组织成员、中国友好邻邦的"四重"身份。故在当前的良好政策形势下,展开"中国新疆——吉尔吉斯斯坦"间的水力资源开发合作,无疑会是一场"双赢"的博弈,即吉尔吉斯斯坦的清洁能源在保障新疆新时期经济社会建设的同时,亦能够换回货币资本以支持吉尔吉斯斯坦的国民经济发展与水力资源的再开发。因此,基于上述的广泛合作基础与前景,对于双方间的跨境水力资源协作形式与过程中可能出现的法律问题进行发掘与对策研究必定具有较强的现实性意义与国际化效应。符合中吉两国国家、人民的根本利益与切实福祉。China’s Xinjiang as the core region of the strategy of ” One Belt and One Road＇’,China＇s important natural resource and frontier business province who want to break through the balance relationship between resource exploit ation and environment protection and overcome the problem in the lack of economic development^ s energy in the future. Kyrgyzstan adjacent with China s Xinjiang who have four identities： water resource nation, member of ＂One Belt and One Road＂,＂SCO＂,and China;s friendly neighbour. To have a cooperation in the domain of water resource between China＇s Xinjiang and Kyrgyzstan which will be a perfect game when the good policies are surrounding. It will bring the clean energy from Kyrgyzstan to hold the new society and economic construction of China＇s Xinjiang and can transform the energy to capital and money to go back to improve the development of Kyrgyzstan. So to search for the legal problems and find out of the specific countermeasure will be useful.
