公共管理视角下我国社区居家养老服务对策研究

摘　　要：当前,社区居家养老已经成为养老的一种新途径,但是,在其发展迅捷的背后也存在不少隐忧,法律风险成为制约其发展的主要瓶颈。而产生这些风险的成因,与我国社区居家养老服务的法律制度不完善、政府引导支持力度不够、社会力量参与不够等有着密切联系。研究其中存在的相关法律问题,营造良性宏观的法律环境,从立法、执法、司法等方面完善社区养老的相关法律法规及政策,建立政府主导、民间资本参与、社会力量补充的多层次、广互动的社区养老服务体系,这对促进我国城市养老体系及整个社会保障体系的完善,促进社会的稳定和发展具有重要意义。Nowadays, home-based care services in communities have become a new trend, but along with the fast development, the services also arouse public concerns; the legal risks have become the major bottleneck. The causes for these risks are imperfection of legal system, lack of the government support and inadequate involvement of social forces, etc. It is of great significance to research the related legal problems, create a benign macro legal environment, perfect relevant laws and regulations from the perspectives of legislation, law enforcement and administration of justice, establish a multi-level and highly interactive home-based care service system under the leadership of the government, with private capital participation and social power supplement to promote the perfection of urban pension system and the whole social security system, and the stability and development of the society.
