摘 要:中央的政策和制度表达着对某种理想状态和秩序的追求,但由于其内容的笼统、原则和不完备,需要地方政府在实施中通过细化、解释和再规划;同时地方政府还需根据本辖区的具体情势,就自己职责范围内的事务做出制度安排,地方政府在制度的生成和创新中扮演着重要的角色。从类型化的角度分析,制度竞争、制度互补和制度学习是地方政府制度创新的主要方式。对它们发生的前提、功效和实现等问题进行分析,既是掌握制度创新方式和过程的重要方法,也是保证地方政府能按照自己扮演的角色行事,实现制度创新过程规范化、科学化的有效路径。The central government' s policies and rules pursuit some kinds of ideal state and order, but their contents are ambiguous, principled and incomplete, so the local government needs to refine, explain and re-plan them. Meanwhile, local governments need to make arrangement on their own affairs according to the specific circumstances of their areas and play an important role in generation and innovation of the rules. From the point of type, rules competition, rules complementation and rules learning are the main ways of local government' s rules innovation. Analyzing the premise, effect and realization is not only an important means to master the ways and processes of rules innovations, but also an effective way to ensure the local governments acting in accordance with their own roles and the rules innovation following the requirements of standardization and seientification.
