摘 要:住宅小区停车位所有权可能归属开发商、中介公司、全体业主以及个别业主等。倘若以住宅小区停车位权属关系为依据,住宅小区停车位的收费可以划分为市场主导的服务型收费、所有业主主导的协商型收费以及个别业主主导的情感型收费。市场收费制度构建以价值规律为准则,但政府应留意住宅小区停车位收费垄断问题;协商收费制度构建应突出住宅小区业主大会或者委员会的主导作用,但制定收费标准应区别对待;情感收费制度构建属于个人行为,可以上升到法律层面约束,但更应强调伦理道德之制约。The fight-belonging of residence community parking spot may belong to developers, agencies, whole owners and individual owners. If the rights-belonging relationship of residence community parking spot is taken as accordance, the charging can be divided into market-oriented service charging, consultative charging leading by owners and emotional type from individual owners. The establishment of market charging system is formulated as value rule, but the government should pay attention the charging monopoly issue. The consultative charging system should highlight the leading effect of the owner commission and committee, but the charging standard should be different. The emotional charging system belongs to individual behavior, which can be restricted by law level but more in morality.
