摘 要:为确保农地抵押贷款可持续发展,必须首先保障抵押权益;在规模经营抵押农地的使用权收益等于小农户农地的经营权收益的前提下,要在农地收益中最大化实现规模经营农地抵押权益,会导致承包农户失去承包财产权及其权益(失权失利)。通过构建五权分置模式并分析三权分置与五权分置的权益匹配关系、权益保障优先序与权益量化对应模式,发现它们都不能同时保障承包财产权益、抵押权益与使用权益。为保护农户承包财产权益,需要试点被处置规模经营抵押农地承包权与所有权转让,优化农地权益结构:一是允许农民向银行抵押并转让承包权,获得承包权交易收益(保利失权);二是将农村集体组织农地所有权短期转让给承包农户(保权失利);三是将农村集体组织农地所有权短期转让给承包农户,承包农户获得承包权交易收益(保权保利)。When the scale management of cultivated land mortgage is realized, contracting farmers lose their contracting and property rights and their represent contract rights (losing right and profit). To protect farmers ~ rights and interests, we need to make experiments on transferring the contracting right and ownership of mortgage land which is disposed and to optimize the structure of cultivated land profits. The first one is to allow farmers to mortgage and transfer the contract right to the bank and gain the profit from the transaction of contract right (losing right but maintaining profit). The second is to give the contract farmers the ownership of rural collective eco- nomic organization of cultivated land (maintaining right but losing profit). The third one is to give the right of ru- ral collective economic organizations of cultivated land ownership to contract farmers. Then the contract farmers will gain the profit from the transaction of contract right (maintaining right and profit).
