法治视域下的卫生改革与发展

摘　　要：从法治基础、法治理念和法治实践三重维度探究法治的要义,对法治视域下的我国卫生改革与发展问题作出阐述。在法治基础维度,从国家社会二元化进程看卫生行政部门职能转型,从公民社会的形成看卫生领域法治社会的塑成。在法治理念维度,强调权利关怀理念和公平正义价值在卫生改革与发展中的重要作用。在法治实践维度,对卫生改革与发展立法中的问题与不足进行梳理,提出增进卫生改革与发展立法的建议。This paper explored the mail ideal of rule by law from three aspects of basic、concept and practice of rule by law, and elaborated the issues of health reform and development. On the dimension of basic of rule by law,transformation of function in the health administrative department can be viewed from dual course with the state, and the establishment of society with the rule by law in the health field can be seen from the formation of civil society. On the dimension of concept of rule by law, the importance of right care concept and the value of fairness and justice in health reform and development has been emphasized. On the dimension of practice of rule by law, problems and shortcomings during the process of health reform and legislation development have been combed and suggestions to promote the health reform and legislation development have been proposed.
