高风险体育旅游项目行政许可范围探究

摘　　要：高风险体育旅游项目是旅游项目的特别种类,《旅游法》规定对高风险体育旅游项目设置行政许可,是为了政府部门有效监管。但我国现行法律中规定有"高危险性体育运动项目"以及"高风险旅游项目",从它们的基本含义来判断,这两类项目都可纳入"高风险性体育旅游项目"。高风险性体育旅游项目行政许可范围是国家法律明确规定的行政许可的事项范围,这个事项范围即是由特定主体依法定程序确定的"高风险体育旅游项目"的项目。在我国法律法规规定不健全的情况下,我们建议应由国家体育总局、国家旅游局联合其他国家机关定期发布高风险体育旅游项目目录,保障高风险体育旅游项目行政许可范围有法可依。High-risk sports tourism project is a special type of tourism projects.In China,the Travel Law provides administrative license over high-risk sports tourism projects for effective supervision from the governmental departments.However,there are terms of＂high risk sports projects＂and＂high risk tourism risks＂in the current Chinas law,which should both be included under the category of high-risk sports tourism projects.The scope of the administrative license of the high-risk sports tourism project is the scope of the administrative license which is clearly stipulated by the state law.The scope of ＂ high risk sports tourism project＂ is determined by the specific subject according to the legal procedure In the absence of Legal regulations in China.The State Sports General Administration,the National Tourism Administration should work with other state institutions and publish high-risk sports tourism project directory in order to follow the highrisk sports tourism project administrative license scope by law.
