论船东互助保赔制度中的互助原则

摘　　要：互助原则是船东互助保赔制度的基本原则,其不仅贯穿和引领船东互助保赔的各项制度,还为船东互助保赔制度的完善提供理论支持。船东互助保赔制度存在法律适用混乱和保险监管缺位等问题。这些问题的解决关键在于遵循互助原则、尊重船东意思自治的产物——会员先付条款,同时在特定情况下兼顾公共利益,例外地允许与之偏离;尊重船东所选择的协会,在普遍对协会进行保险监管的同时,为协会制定与之相适应的监管标准。Principal of Mutuality is the basic principal of the shipowners mutual protection and indemnity regime, which is not only reflected by the legel devise thereof, but also prvoide the theory supoort for the regime. So far, the private law and supervision regulation apply to the regime still remains an open question. To solve this problem, Principal of Mutuality show some guild lights, that resepect the freedom of contract and give effect to the pay first rule, while allows deviate from it considering the public interest in particular circumstances, and resepect the shipowners＇ choice of the special model for running the club and provide a more propriate regulatory system.
