两岸学生往来相关法律法规与实务问题研究——基于“两岸交换生”群体的问卷调查

摘　　要：两岸青年学生往来关系到两岸关系发展的未来,处理好相关法律问题,维护好两岸学生的基本权益,有利于两岸关系的深化与巩固。通过对两岸交换生群体的现状调研发现两岸在奖学金、学分采认、社会保障、就业与兼职等方面的法律法规存在差异性,表现出台湾法规的歧视性和大陆立法的不完善性等问题。一方面,应以两岸协议的方式化解修法难题,在此基础上促进台湾修法,即从基本人权的角度注重保护大陆赴台学生教育权、健康权和生存权;同时,促进大陆涉台立法在位阶上和可操作性上的全面完善。另一方面,应加强对高校管理人员涉台立法的培训及在台生入学环节的宣传,设置涉台生法律法规网上查询入口,发挥涉台社团组织服务台生的作用。The current relationship of cross - strait young students closely relate to the future of cross - strait relations development. The proper settlement of the relevant legal issues and the well protected of the basic rights of the crossstrait students will help to deepen and strengthen the cross - strait relations. Through the current situation survey data of the cross - strait students, the laws and regulations relate to the aspects of scholarship, the credit recognition, social security, employment and part -time jobs, embody some differences between both sides. It shows the discrimination of the regulations of Taiwan and the imperfection of the legislations of China's Mainland. Suggestions are as follow, on the one hand, solve the difficult problems of the amendment of laws with the way of signing cross - strait agreements, and promote the amendments of the regulations of Taiwan on the basis of above. That is to say, focus on the protection of the basic rights to education, health and subsistence of the China's Mainland students studying in Taiwan from the perspective of basic human rights protection. Meanwhile, promote the comprehensive improvement of the legislative level and maneuverability of the China's Mainland regulations which relate to Taiwan students. On the other hand, strengthen the university administrators training of regulations relate to Taiwan and the propaganda of the school entrance of students from Taiwan, set up the relate regulations query entrance for Taiwan students, to exert the serving students from Taiwan foundation of Taiwan related communities and organizations.
