论法的确定性之“静”与法的灵活性之“动”——以世界三大法系为切入点

摘　　要：法律的确定性与灵活性是自古以来就存在的一对矛盾。法律的确定性满足了人们对于安定生活的追求,有利于稳定的社会秩序的形成。法律的灵活性可以有效解决僵化的法律与社会生活之间的矛盾,将各种社会问题纳入法律的调整范围中,在一定程度上维护了法的稳定性。通过对民法法系、普通法法系、伊斯兰法系这三大法系的考察,发现各大法系在应对法律的灵活性与确定性的问题上都各有特色。在当今世界大环境下,单一的法律形式已无法满足各大法系对法律确定性与灵活性的追求,因此加快吸收其他法系的优秀法律成果、完善自身势在必行,这为我国法治国家的建设指明了方向。The certainty and flexibility of law is a pair of contradiction since the ancient times. The certainty of law meets the demand that the people pursue stable life, which is beneficial for the formation of a steady social order. The flexibility of law can effectively solve the contradiction between the rigid law and social life and put all kinds of social problems in the legal ad- justment range to maintain the stability of the law in a certain extent. Through studying the civil law system, common law sys- tem and Islamic law system,we can find they all have their own special methods in dealing with the problems between the cer- tainty of law and the flexihility of law. Nowadays,in the political and economic environment of the world,single legal form has been unable to pursue the certainty and flexibility of law for the three legal systems. Thus, it is urgent to accelerate the absorp- tion of outstanding legal results in other law systems to improve themselves. At the same time, it pointed out the direction for the construction of our country under the rule of law.
