摘 要:科学处理兵团与地方关系是新时期新疆工作的一个重要内容,事关新疆社会稳定和长治久安。兵团与地方关系的核心是兵团法律地位界定,而依托法治实现兵团与地方关系的和谐,既是依法治国在新疆的具体体现,也是中央第二次新疆工作座谈会提出的"依法治疆"的题中之意。因此,正确处理兵团与地方关系要在法治视野下实现:明晰兵团组织法律资格、积极发挥区域行政协议、司法调节的积极作用,其中在"建城戍边"战略中推进"师市合一"是当下解决兵团法律主体资格的最优途径。依托法治科学处理兵团与地方关系,促进兵地共融,形成发展合力以确保新疆社会稳定与长治久安。The relationship between the Xinjiang Production and Construction Corps (XPCC)and the Xinjiang Uygur Autonomous Region, also known as BingDi relationship, is an important content to achieve leapfrog development in Xinjiang,as well as the social sta- bility and long-term stability. The legal status of the XPCC is the core of relationship . Therefore, for nomoeracy in China and Xinjiang, this relationship will be developed by the nomocracy. There are three main contents: the legal qualifications for the corps organization, the governmental administrative agreement and the judicial regulation. The optimal one is "Shihezi model", which can define the XPCC' s legal qualification. A harmonious relationship between XPCC and Xinjiang Uygur Autonomous Region will ensure social stability and long-term stability of Xinjiang.
