摘　　要：针对实务工作中,时常会遇到的关于权利要求中非必要技术特征的删除是否导致超范围的问题。本文首先辨析了必要技术特征以及非必要技术特征的概念;接着从专利法第33条立法本意的角度分类讨论了不同技术特征删除是否导致超范围;最后结合两个案例,重点分析了当删除的非必要技术特征为公知常识和下位设置这两种类型时不会导致删除超范围。In the case of practical work, we often encounter in the removal of non-essential technical features in the claim, which is leading to go beyond the scope problems.In the paper, firstly, analyzing the necessary technical characteristics and the concept of non-essential technical characteristics ; then, discussing that which kind of removing of the different technical features may lead to go beyond the scope by the Article 33 of the Patent Law ; finally, combining the two cases, analyzing that deletion of non- essential technical features are known for both common sense and lower-level settings do not result in go beyond the scope.
