绿色发展理念下我国环境立法的缺陷与完善路径

摘　　要：绿色发展理念是正确处理环境保护与经济发展关系的新型发展理念。在环境立法中落实绿色发展理念,是可持续发展理念在中国实现本土化的法治化过程与手段。以我国环境立法体系为切入点,从宏观层面概括分析我国环境立法存在的主要问题,指出我国环境立法必须以绿色发展理念为指导,在立法中要充分体现绿色发展理念,加强生态立法体系建设,完善环境法律制度,从而确保绿色发展的顺利实施。Green development conceptis a new type of Development philosophyaimed at handling the relation between of environmental protection and economic development. Practiced this concept in environment legislation is the process of legalization and means for sustainable development localization in China. We analyzed points of our environment legislation sys- tem from the macroscopic level as the breakthrough point. Then, pointed out green development concept must be the the guiding ideology for environment legislation. At the same time, in order to make sure that green development can go on wheels, we should fully implement the concept in legislation and perfect ecological legislation system and environmental legal systems.
