中国亚洲象肇事致损、补偿的现状与政策分析

摘　　要：目前在我国,人与亚洲象冲突已成社会热点,亚洲象肇事致损情况严重,相应的亚洲象肇事补偿措施实施效果如何值得关注。文章搜集了西双版纳亚洲象肇事致损与肇事补偿的资料与数据,分析发现:(1)在肇事致损方面,亚洲象肇事致损占西双版陆生野生动物致损损失的80%以上,涉及人身伤亡、农作物损失及经济作物损失等。仅2011年亚洲象肇事共造成882.486万元的经济损失,其中农作物和经济作物损失占95.05%。(2)在肇事补偿方面,亚洲象公众责任保险实施前后的平均补偿率从14.31%上升到90.84%,各补偿标准显著提高。针对研究结果,提出了完善政策法规、建立和完善野生动物肇事补偿机制、实施云南省野生动物肇事全省联保等有助于我国亚洲象肇事致损与补偿管理的针对性建议。At present, the conflict of Asian Elephant and people in China has become the social hot spot, and the loss causedby Asian elephant is serious. Therefore, it is worth paying attention to the implementation of the appropriate compensationmeasures for the loss caused by the Asian elephant. On the basis of the collection, the paper found that （1） In the accidentdamage, the loss caused by Asian elephant accounted for more than 80 percent of the loss caused by all terrestrial wildlife inXishuangbanna, including physical casualties, crop loss and cash crop loss and so on. Only in 2011, the Asian elephant accidentcaused a total of 8.825 million CNY of economic losses, of which the loss of crops and economic crops accounted for 95.05%. （2）In the accident compensation, the average compensation rate of Asian elephant rose from 14.31% to 90.84% because of publicliability insurance, and each compensation standard was significantly improved. According to the results, this paper suggestedimproved policies and regulations, established and perfected the compensation mechanism of wildlife animal, implementedpublic liability insurance for all wildlife animals in the whole Yunnan province and so on, in order to manage the Asian elephantaccident damage and compensation better.
