摘 要:在第八次特赦中,"不具有现实社会危险性"首次成为特赦的实质条件。在我国刑事程序法和实体法语境中,也存在社会危险性的表述,但认识比较混乱。现实社会危险性需要通过客观证据来证明,现实社会危险性的判断要将罪犯的现实表现作为判断依据。"现实社会危险性"只能采取封闭式的立法模式,"现实社会危险性"的表述不宜直接出现在立法文本中。"现实社会危险性"应当包括继续危害社会的可能,以及存在诉讼风险两种情况,但有犯罪记录未必就属于具有"现实社会危险性"。特赦中"现实社会危险性"的含义可表述为:通过客观证明可以证实,服刑罪犯在被释放后,存在继续危害社会、妨碍诉讼等情形的可能性。The exclusion of 'social danger in reality'has been the substantive condition for special amnesty in the first time during the Eighth Special Amnesty. There also exists the expression of 'social danger'in Chinese Criminal Law and Criminal Procedure Law,but the meaning of which has not reached consensus. 'Social danger in reality'needs to be proved by objective evidence,the judgment of which should be based on the real behavior of the criminal. For the legislation of special amnesty, 'social danger in reality'could only be adopted in the enclosed legislative model and is not appropriate to be explicitly regulated in the text. 'Social danger in reality 'shall include the possibility of the continuation of endangering society and the risk of litigation, but the record of crime and the incomplete confession with rejection of punishment shall not be regarded as 'social danger in reality'. In the discussion of special amnesty,the meaning of 'social danger in reality'could be construed as 'after the release of prisoner,it could be objectively proved that it is possible to continue to endanger thesocial and obstruct litigation'.
