防治建设工程招投标中的串标围标行为思考

摘　　要：指出了在我国现阶段的建设工程项目招投标活动中,串标围标的现象屡见不鲜,危害也日益明显。分析了促使这一现象产生的原因在于我国关于招标投标法的法律制度不够完善、监督管理部门监管不集中、市场信誉系统不够健全、评标委员会管理不够严格等。针对这种违法违规的现象,提出了应出台并完善相应的法律法规,加强监督管理,并加快脚步建设全国统一的招投标运作机制和信誉系统,做到使招投标活动公开透明、公正有序,才能有效地防止串标围标现象的产生。In the bidding project of construction project in our country, the phenomenon of surround--bidding and collusive bidding is not uncommon and the harm is becoming more and more obvious. The reason for this phenomenon reflects in several aspects. Chings legal system of bidding and tendering is not perfect; supervision and management departments are not centralized; the market reputation system is not perfect; the evaluation committee is not strict e- nough. In view of this illegal phenomenon, corresponding laws and regulations should be introduced to strengthen supervision and management. Meanwhile, our country should accelerate the pace of building a unified national bidding and operation mechanism and reputation system. Therefore, bidding activities are open and transparent, fair and orderly in order to effectively prevent the bid--rigging collusion behavior.
