摘 要:尽管我国宪法和法律没有赋予最高人民法院宏观调控的职权(职责),但它还是积极主动地介入到宏观调控。最高人民法院介入宏观调控,虽然具有一定的合理性,但也为我国法治建设带来隐忧。罗斯福新政时期,美国最高法院介入宏观调控的经验教训,给我国有益启示。从法治的立场看,最高人民法院在宏观调控中应保持司法克制。Although the Supreme People' s Court of China is not vested the power or duty of macro-economic adjustment and control by China' s constitution and law, it still actively takes part in these activities.To a cer- tain extent, it is reasonable that the Supreme People' s Court of China gets involved in macro-economic adjust- ment and control, but it also brings latent dangers to China' s law system construction. During the period of Roosevelt' s New Deal, the Supreme Court of the United States' intervention in macro-economic adjustment and control gives us beneficial enlightenment.From a perspective of rule of law, the Supreme People' s Court of China should exhibit certain judicial restraint in its macro-economic adjustment and control.
