摘 要:立法监督的通说概念混淆了立法活动本身和立法结果之间客观存在的差异。将立法活动过程本身纳入立法监督的范围之中,不适当地扩大了立法监督的范围。目前,我国以权力机关与行政机关为主导的立法监督,即全国人大及其常委会与国务院在立法监督中占主导地位的模式存在着较大的缺陷,立法监督难以得到有效实施。立足实践与相关规定,充分发挥法规范的直接适用者人民法院在立法监督中的作用,利用级别管辖制逐步实现对法律性规范的有效监督,应当成为激活立法监督制度的重要途径。The general concept of legislative supervision confuses the differences between the legislative activities and the legislative results. Taking the process of legislative activities into the scope of legislative supervision inap- propriately expand the scope of legislative supervision. At present, there is a big flaw in China' s legislative super- vision led by the powerful authorities and administrative organs, namely, the model of NPC and its Standing Com- mittee and the State Council dominant in the legislative supervision, so the legislative supervision is difficult to be effectively implemented.
