摘　　要：环境污染强制责任保险指的是污染环境的被保险人依照法律的强制性规定,对其污染环境所应承担的环境侵权损害赔偿责任必须投保,而保险人必须承保的保险。我国缺乏明确的法律法规对环境污染强制责任保险进行规定,环境污染强制责任险陷入"叫好不叫座"的尴尬局面。环境污染强制责任险的推行是现实的需要,对保护环境、受害人救济、企业风险防范都起着积极的作用。然而环境污染强制责任险的推行过程中,缺乏配套的强制手段,因此必须采取平衡保险主客体的成本与收益、以及行政手段与刑事手段相结合等刚柔相济的手段以推动环境污染强制责任险的推行。The environmental pollution of compulsory liability insurance refers to the environmental pollution by the insured in accordance with the mandatory provisions of the law, the environmental pollution of the environment tort liability must be insured, the insurer must be covered by the insurance. China＇ s lack of a clear legal laws and regulations on environmental pollution compulsory liability insurance regulation, compulsory liability insurance of environmental pollution into the awkward situation of ＂failed to sell＂ . The implementation of compulsory liability insurance of environmental pollution is the need of reality, to protect the environment, the victim relief; enterprise risk prevention plays a positive role. However, in the process of the implementation of compulsory liability insurance of environmental pollution, the lack of form a complete set of coercion, so must take rigid-flexible economic means to promote the implementation of compulsory liability insurance of environmental pollution.
