文献传递的复制权例外问题探讨

摘　　要：文章从高校图书馆文献传递工作在实施过程中缺乏行业规范的现状出发,论述文献传递服务面临的复制权困境以及复制权例外应用于文献传递服务的理论依据,并提出从复制主体的责任、复制件使用限制、文献传递系统的技术控制和责任豁免四个方面完善文献传递服务框架,将复制权例外纳入对服务过程的管理,使文献传递服务与复制权例外立法进行积极的相互推进,进而推动图书馆资源共享服务的进一步开展。参考文献11。Starting with the current situation that the industry standard is absent during putting document delivery into practice in uni- versities libraries, this paper discusses the copyright dilemma of document delivery and the theoretical principle of duplication right exception applied to document delivery, puts forward to improve the service framework of document delivery from the four aspects： responsibility of the copy subject, copies using limitation, technical control of document delivery system and exemption from liability, to put duplication right exception into the management of the service process in order to bring active promotion of document delivery and the legislation of duplication right exception so as to promote the sharing service of library resources.
