民法中恢复原状的生态化表达与调适

摘　　要：我国立法未有针对环境损害的修复责任规则,多借助民法中恢复原状来实现环境损害的修复性救济,并对恢复原状内涵进行了拓展,逐渐形成了基于生态整体而非局部、动态而非静态、多元价值而非单一目标、遵循自然规律的独立环境修复责任。在民事私益诉讼与公益诉讼二元划分的格局下,环境修复在私益诉讼中基于民事事务的自主品格而具有可选择性,在公益诉讼中基于社会公益的考量而被塑造为核心责任方式。经过环境司法实践对恢复原状的不断改造和调适,确立了环境修复责任的首适规则,对环境修复标准进行差异化分类配置,促使恢复原状适用条件在环境损害中由严格走向宽松,以充分发挥恢复原状责任方式对环境损害的补救功能。Recovery liability rule aiming at environmental damage has not been established in the legislation of our country yet, and we always turn to the liability in restitution in Civil Law to achieve reparative relief of environmental damage, as well as expand its connotation so as to gradually develop independent environmental remediation liability which not only far more focuses on the ecological unity and a multi-value goal dynamically rather than the parts and a single goal statically but also follows the law of nature. In the structure of dual-division about civil private benefit lawsuit and public interest litigation, environmental remediation is selective based on the characteristics of civil affairs in the civil private lawsuit, and is shaped the core liability form in consideration of social benefits in the public interest litigation. By constantly reforming and adjusting liability in restitution in environmental judicial practice, the rule of environmental remediation liability is firstly established, the applicable conditions of liability of restitution range from strict to lenient in environmental damage by means of differently classifying and configuring environmental remediation standards, and finally it can fully plays a significant role in remediation function in environmental damage.
