摘  要:我国当下行政行为理论对形式违反的定性主要采无效、违法、瑕疵"三分法",不能穷尽行政实践中的各种情形,应加紧对形式违反进行无效、一般违法、轻微违法、明显不当、不当、瑕疵、轻微瑕疵、错误等类型化体系构建。当下行政审判实践中动辄将形式违法甚至无效误断作"瑕疵",其认定理由难以理论自洽,也不利于践行程序独立价值。为此,应严格限定形式瑕疵及其补正的适用范围,以法明确形式瑕疵与违法之间的界限,纠正传统理论中对要式行为的错误定位。The violation against form is predominantly categorized into invalid, illegal and defective under the current administrative act theories in China, which is far from covering various forms of such violation in the administrative practice. As a result, the establishment of categorized system including invalidity, general breach of law ( s), minor breach of law (s) , apparent improperness, improperness, defect, minor defect and wrongdoing shall be accelerated. The proneness to regard Formal Illegality as Defect under the current administrative adjudication is self-incon- sistent in theories, and also non-conducive to implement the value of procedural independence, for the purpose of which, the application scope of formal defect and the correction thereof shall be strictly limited, so as to clarify the boundary between formal defect and breach of law (s) , and correct the wrong positioning over formal act by traditional theories.
