论集体建设用地使用权的出让——以立法文本和问卷调查为基础的分析

摘　　要：通过对地方立法文本和调查问卷的分析,总结了有关集体建设用地使用权出让的地方立法经验和民间法律意识,包括出让的权利主体、出让的权利基础、出让权利的期限和用途、出让的条件和程序、集体出让建设用地使用权和宅基地使用权人转让使用权的关系、集体土地使用权的收回、土地出让收益分配等。这些地方立法表现出很多和大陆法系物权观念不一致的情形,例如出让主体的模糊与复杂,集体以使用权为基础予以出让,国家虽然不是所有权人但却分享集体出让的收益等,这说明了法学理论和实践的差距,也需要法学界进一步做出回应。By analyzing the local legislations and questionnaire, I summarize the local lessons of legislations and legal sense of common people about the grant of land use right tor construction by collectives especially at me points of subject, right foundation, the term and purpose of land use right, the condition and procedure, it＇ s being taken back and distribution of interests. Among them are that some collectives grant the inferior land use right based on a higher one,the government can share the benefit of the grant,though it is not the owner of the land. These de-serve deeper understanding and more detailed analyses.
