论束缚关系下的正当防卫——从受虐妇女杀夫案件切入

摘　　要：束缚关系是一种特殊的"加害——被加害"关系:存在稳定的单向暴力;加害方居于优势地位;被加害方难以逃脱束缚;被加害方对即将实行的不法侵害具有高度预见性。考虑到束缚关系的特殊性,应将被加害方在致命性不法侵害即将实行时实施的防卫行为正当化。"正在进行"不同于"正在实行",《刑法》第20条"正在进行的不法侵害"可以解释为"正在实行或即将实行的不法侵害"。束缚关系下正当防卫的发现,有利于精准解决特殊困难案件,实现公民自我保存权和法秩序平和之间的动态平衡。Bonding relationships are special ties between assailants and victims, which are full of unilateral violence. It is difficult for the victims to escape from the bond and make confrontational response to the assailants who have preponderance. Taking their interactions into account, it is justified for the victims to respond the deadly upcoming unlawful forces or threats. “Being processed” is different from “being committed”,so the provision of “unlawful acts being processed”,which states in the Article 20 of the Chinese Penal Code, includes acts being committed and acts about to commit. Through this interpretation, the right of self-reserve could be in harmony with the law order.
