摘　　要：侦查要素、侦查结构、侦查功能是侦查学范畴体系中三个相对独立的范畴,各自有其性质、结构和功能,同时侦查要素、侦查结构、侦查功能三者间又密切关联。侦查要素是侦查有机整体的组成部分,是构成侦查系统的基本单位;侦查结构是侦查各构成要素之间合乎规律的、稳定的联系和相互关系;侦查功能是侦查能起的作用,是侦查性质的实现。一方面,侦查性质决定侦查结构,侦查结构决定侦查功能;另一方面,侦查结构的变化引起侦查性质的改变,进而决定侦查的功能。因此,将侦查要素、侦查结构、侦查功能及三者的关系认识清楚,准确定位,是侦查学范畴体系研究应有的内容,这对完善侦查学理论体系具有重大意义。Elements, structure and functions, with their respective nature, structure and functions, are relatively independent from each other, but meanwhile are correlated with each other. Elements of investigation are one of the components of investigation as a organism, and also fundamental units of investigation system. Structure of investigation refers to the stable and regular links and relations among all the elements to constitute investigation. Functions of investigation means the effects of investigation, which reflects the nature of investigation. On the one hand, the nature of investigation determines its structure which in turn determines its functions. On the other hand, changes of the investigation structure causes changes in its nature, which further influences its functions. Therefore, it should be a necessary content of investigation research to clearly understand and correctly define elements, structure and functions of investigation and their relationship, which bears great significance for perfecting the theoretic system of investigation.
