论军队刑事侦查权的军事性与法律性

摘　　要：军队刑事侦查权军事性即高效维护军事利益性,这是由军事法效率价值决定的。实践中,军队刑事侦查权军事性表现相对突出。而军队刑事侦查权法律性则为维护军事法公平正义性,这是由军事法公正价值决定的,但军队刑事侦查权法律性现实表现相对不足。基于对立统一规律、法价值冲突协调原则及军事法价值共荣性,军队刑事侦查权军事性与法律性协调统一既是必要的,也是可行的。Military criminal investigation of military force refers to the efficient maintenance of military interests. This is determined by the value of military law efficiency. In practice,the military criminal investigation of military performance is relatively prominent. The legal nature of criminal investigation is the maintenance of military law fairness and justice,which is determined by the fair value of military law. However,the legal performance of the criminal investigation power is relatively inadequate. It is necessary and feasible to harmonize the military and legal nature of military criminal investigation based on the principle of harmonization of opposites,the principle of conflict of values and the coexistence of military law.
